DISTANCE SALES / SERVICE CONTRACT
Pursuant to Article 3 of the Law No. 6563 on the Regulation of Electronic Commerce and the provisions of the relevant legislation, information regarding BYA ORGANIZATION TOURISM AND CONSULTANCY TRADE LIMITED COMPANY (hereinafter referred to as “BYA” or “seller”) is provided in the section of our website titled “Contact Us”.
1.PARTIES
This Distant Sales Agreement (“Agreement” for short) has been concluded between BYA ORGANIZATION TOURISM AND CONSULTANCY TRADE LIMITED COMPANY (“BYA” for short) (Mecidiyeköy Tax Office / Tax No: 3341097873) and the customer who made the purchase.
The Customer irrevocably accepts, declares and undertakes that he/she has read the entire Distance Sales Contract, understands its content in its entirety and approves all its provisions.
2.SUBJECT AND SCOPE OF THE CONTRACT
This agreement has been prepared in order to determine the principles regarding the sale of tickets to customers regarding the conference and summit events organized by BYA.
The customer accepts, declares and undertakes to act in accordance with any statement or explanation on the website www.csummitseries.com.tr and to comply with the special terms and conditions of the event.
3. TERMS AND CONDITIONS FOR EVENT TICKET SALES
3.1. The customer accepts, declares and undertakes that he/she has purchased the ticket purchased for the events without any commercial purpose and that he/she will not use the ticket for any commercial business or commercial activity. The purchased ticket cannot be sold to third parties in any way whatsoever, cannot be transferred, cannot be offered for sale with an additional fee or in any other way, cannot be used for promotional or other commercial purposes, including advertising, contests and sweepstakes. The sale or attempted sale of the ticket at a price higher than the price printed on the ticket constitutes a justifiable reason for the cancellation of the right to participate in the event, without any refund or other claims.
3.2. The customer accepts, declares and undertakes that the sale of the ticket sales service is a final sale and that they do not have any cancellation, return or change rights regarding the tickets purchased in accordance with Article 15-g of the Distance Contracts Regulation. Except in case of cancellation of the event, the tickets sold are not canceled, changed or refunded in any way after the sales transaction.
3.3. Tickets may sell out, close for sale or additional tickets may reopen for sale. BYA does not have any control over the availability of tickets or provide any guarantee in this context.
3.5. BYA will not charge the customer any fees other than the ticket price, food and beverage price, service fee stated on the website.
3.6. At the stage of confirming the order and before entering the payment information, the customer accepts, declares and undertakes that by purchasing tickets and confirming the order, the customer will be deemed to have accepted all the terms of the contract, including the total price to be paid.
3.7. The customer undertakes to use correct and up-to-date information when purchasing a ticket. The customer accepts, declares and undertakes that BYA is not responsible for any problems that may arise in accessing tickets and/or events due to inaccurate or outdated information and does not have any rights in this regard.
- MATTERS THAT THE CUSTOMER IS INFORMED ABOUT
The Customer accepts, declares and undertakes that prior to the creation of the order and the establishment of the Agreement, he/she has been accurately and completely informed about all matters related to the conclusion and implementation of the Agreement, including the following, both in the explanations on the website and in the Agreement and similar forms, and that he/she has read and understood them.
- Key attributes of the Product/Service,
- The name or title, MERSIS number or tax identification number and contact information and other identifying information of the Seller,
- Clear address, telephone number and similar contact information that allows the customer to quickly contact the seller, and the identity and address of the person acting on behalf or account of the seller, if any,
- Accepted payment methods and means for the Product/Service, total sales price of the Product/Service including taxes,
- The rules of confidentiality, data use, processing and electronic communication applicable to the Customer information applied by the Seller and the scope of the permissions given by the Customer to the Seller in these matters, the legal rights of the Customer, the rights of the Seller and the procedures for exercising the rights of the Parties,
- Information on the conditions under which the customer will not benefit from this right in cases where the customer cannot exercise the right of withdrawal or will lose this right, including failure to exercise the right in due time,
- Information that in case of disputes, the Customer may apply to the Consumer Court or the Consumer Arbitration Committee.
5. CONTRACT AMENDMENTS
BYA may, at its sole discretion and unilaterally, amend this Distance Selling Agreement at any time it deems appropriate by posting it on its website. The amended provisions of this Distance Sales Agreement shall become effective on the date they are announced on the website; the remaining provisions shall remain in full force and effect and shall continue to give rise to their provisions and results. This Agreement cannot be changed with the unilateral declaration of the customer.
6.FORCE MAJEURE
BYA shall not be held liable for late or incomplete performance or non-performance of any of its obligations set forth in this Agreement in all cases deemed to be legally force majeure. In these and similar cases, compensation cannot be claimed from BYA under any name. The term “force majeure” shall be construed as unavoidable events beyond the reasonable control of the relevant party and which it could not have prevented despite exercising due diligence, including but not limited to natural disasters, riots, war, strikes, communication problems, infrastructure and internet failures, power outages, social events, election date changes and bad weather conditions.
7.CONFIDENTIALITY AND SECURITY
BYA website“www.csummitseries.com.tr” belongs to BYA ORGANIZATION TOURISM AND CONSULTANCY TRADE LIMITED COMPANY. Information security and confidentiality of Customers who visit the Website are ensured.
The parties agree that the processing of personal data belonging to the customer, including personal data of special nature, is not covered by the Personal Data Protection Law No. 6698 (KVKK) since it is directly related to the establishment and performance of the contract between the parties. For the processing of personal data other than the legal exceptions, BYA will collect and process the personal data obtained from the customer in the capacity of data controller, limited to its obligations under the Law, Regulation, Communiqué and other secondary legislation, the establishment and performance of the contract.
The real person whose personal data are processed may apply to BYA to learn whether his/her personal data are processed, to request information if such data are processed, to learn the purpose of processing personal data and whether they are used in accordance with their purpose, and to learn the persons and places if personal data are transferred both domestically and abroad, BYA has the right to request correction of personal data in case of incomplete or incorrect processing of personal data, to request deletion of personal data if the conditions are met, to notify third parties to whom personal data is transferred in case of correction or destruction of personal data, to object to the results arising from automated processing, and to demand compensation for damages in case of damage due to unlawful processing of personal data.
BYA will be able to transfer personal data relating to natural persons where there is adequate protection for the protection of personal data in accordance with the provisions of the Law and/or in accordance with the relevant legislation. The personal data owner has expressly consented to the processing of personal data within this scope.
In case BYA works with different organizations, it is ensured that these companies comply with the privacy standards and conditions.
The copyrights on the information, all kinds of content and materials on the website and their arrangement belong to BYA ORGANIZATION TOURISM AND CONSULTANCY TRADE LIMITED COMPANY. All copyrights, trademarks, patents and/or all other intellectual and industrial property rights in the information and materials contained on the Site are reserved.
- FINAL PROVISIONS
Customers have been informed by BYA about the provisions and content of the contract before purchasing tickets and/or menu/events, and by purchasing tickets and/or menu/events and confirming the order, customers accept and declare that they have been informed about the content of this contract within the framework of the Consumer Law and Distance Contracts Regulation.
In the event of any dispute in the application of the terms and conditions stated above, the resolution of disputes is subject to Turkish Law.
The Customer has the right to apply to the Consumer Arbitration Committees and / or Consumer Courts within the framework of the monetary limits published in the relevant legislation in possible disputes arising from this contract.
Istanbul Courts and Enforcement Offices are authorized in all disputes arising from the contract.
This agreement consists of 8 (eight) articles and has been read by the parties and has been concluded and entered into force by being approved electronically by the customer. A copy of the Agreement may be sent by e-mail if requested by the customer.
